Reported Case(s):
Data Concepts, Inc. v. Digital Consulting, Inc., 150 F.3 620 (6th Cir. 1998). Mr. Haight represented Digital Consulting in a trademark dispute. The case settled favorably for Mr. Haight’s client after the Court of Appeals affirmed the District Court’s holding that Data Concepts was not the senior user of the mark at issue. This case established the precedent in the Sixth Circuit that whether a later trademark is the legal equivalent of the earlier one, such that use of an earlier mark may be tacked onto use of a later mark for seniority purposes, is a question of law.
